By accessing or using ReviewNest (the "Service"), operated by D13 AI Inc. ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

ReviewNest is an AI-powered review management platform that helps business owners monitor, analyze, and respond to customer reviews across multiple platforms. Features include review aggregation, sentiment analysis, AI-generated responses, QR campaign management, and review performance analytics.

3. Accounts

3.1 Account Creation

You may create an account using an email address and password, or by authenticating with Google ("Continue with Google"). You must provide accurate and complete information during registration and keep your account information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that could harm us or other users.

4. Acceptable Use

  • Scrape, data-mine, or harvest data from the Service beyond normal use, or resell access to the Service.
  • Use any automated means (bots, scripts) to access the Service except through our official APIs.
  • Transmit viruses, malware, or any other malicious code through the Service.

5. Intellectual Property

The Service, including its design, code, AI models, branding, and documentation, is owned by D13 AI Inc. and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works based on the Service without our written consent.

6. User Content

You retain ownership of any content you submit through the Service (e.g., custom review responses, business information). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely to provide and improve the Service.

7. Third-Party Services

The Service integrates with third-party platforms (e.g., Google for authentication, review platforms for data aggregation). Your use of those platforms is governed by their respective terms and privacy policies. We are not responsible for the content, availability, or practices of third-party services.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

AI-generated responses and analytics are provided for informational purposes and should be reviewed by you before use. We are not responsible for the accuracy or consequences of AI-generated content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, D13 AI INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless D13 AI Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of a third party.
